Arca 9 is a creative design and technology studio specializing in user experience (UX/UI), Web and App development, branding, digital design, and related creative services.

Our website and all materials, including our logo, content, business names, domain names, designs, client’s portfolio and all other intellectual property, whether registered or unregistered (the “Rights”). These Rights either belong directly to us or our clients. 

No content from any part of this website may be reproduced, distributed, or reused without our prior written consent. 

4. Services and Proposals

Any quotes, proposals, and project deliverables shared by Arca 9 are confidential and intended solely for the recipient.
Each project is governed by a separate agreement that outlines scope, deliverables, timelines, and payment terms.

5. Payments

All payments must be made as per the terms stated in the project proposal or invoice.

4) Fraud

Arca 9 reserves the right, but undertakes no obligation, to actively report and prosecute actual and suspected credit card fraud. Arca 9 reserves the right to cancel, any service if fraud is suspected. Arca 9 has your basic information during your onboarding process, including time, date, IP address and other information that will be used to locate and identify individuals committing fraud. If any order is suspected to be fraudulent, Arca 9 reserves the right, but undertakes no obligation, to submit all records, with or without a subpoena, to all law enforcement agencies and to the credit card company for fraud investigation. Arca 9 reserves the right to cooperate with authorities to prosecute offenders to the fullest extent of the law.

6. Ownership

Arca 9 reserves the right to showcase completed work in its portfolio and marketing materials unless otherwise agreed upon in writing.

7. Limitation of Liability

Arca 9 is not liable for any direct, indirect, or consequential losses including without limitation, damages for loss of revenues, profits, goodwill use of Data or other intangible losses, resulting from the use of our website or services.
We make ‘No’ guarantees that the website or its content will always be available, uninterrupted, or error-free.

8.  Force Majeure

Arca 9 will not be held liable for any delay or failure in performance or delivery of any service due to acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, system failures, software bugs, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, earthquakes, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

9. Arbitration

You and Acra 9 agree that we will resolve any disputes between us through binding and final arbitration instead of through court proceedings. You and Arca 9 hereby waive any right to a jury trial of any Claim. All controversies, claims, counterclaims, or other disputes arising between you and Arca 9 relating to the Site or these Terms of Use (each a “Claim”) shall be submitted for binding arbitration in accordance with the Rules of the American Arbitration Association (“AAA Rules”).
